These Terms of Service ("Terms") constitute a legally binding agreement between you and Flocast LLC ("Flocast," "we," "us," or "our") governing your access to and use of the Flocast application and services available at flocast.net ("Service").
By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Flocast is intended for use by adults aged 18 and older. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.
Flocast is a financial technology application that provides small business owners with cash flow forecasting, expense tracking, invoice management, and AI-powered financial insights. The Service connects to your business bank accounts via Plaid to retrieve transaction and balance data on a read-only basis.

Flocast offers a 30-day free trial with full access to all features. No payment is required to start your trial. At the end of the trial period, your account will require an active subscription to continue accessing the Service.
The Flocast subscription is $29.99 per month, billed monthly. By subscribing, you authorize Flocast to charge your payment method on a recurring monthly basis until you cancel. Billing occurs on the same calendar date each month.
You may cancel your subscription at any time through the Billing & Plan section of the app. Cancellation takes effect at the end of the current billing period. You will retain full access until that date. No partial refunds are issued for unused time within a billing cycle.
We may change our pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes your acceptance of the new price.
Flocast uses Plaid Technologies, Inc. to connect to your financial institutions. By connecting a bank account, you agree to Plaid's End User Privacy Policy (available at plaid.com/legal/end-user-privacy-policy). Your use of Plaid is subject to Plaid's terms in addition to ours.

Flocast includes an AI-powered assistant powered by Anthropic's Claude. The AI assistant provides general financial insights and scenario analysis based on your data. You acknowledge that:
The Flocast application, including its design, code, features, and content, is owned by Flocast LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.
You retain ownership of all data you upload or generate through the Service. By using the Service, you grant Flocast a limited license to process your data solely to provide the Service.
The Service provides financial information and forecasting tools, not professional financial, investment, tax, or legal advice. Always consult qualified professionals for important financial decisions.
We strive for high availability but do not guarantee uninterrupted access to the Service. We are not liable for losses resulting from temporary outages, maintenance periods, or service disruptions.
Flocast displays data from your connected bank accounts and forecasts based on historical patterns. We do not guarantee the accuracy of forecasts or AI-generated insights. Actual financial outcomes may differ materially from projections.
To the maximum extent permitted by law, Flocast's total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to Flocast in the 12 months preceding the claim. Flocast is not liable for indirect, incidental, special, or consequential damages.
You may terminate your account at any time by contacting support@flocast.net or using the account deletion feature in the app. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your data will be deleted in accordance with our Privacy Policy.
We may update these Terms from time to time. When we make material changes, we will notify you via email at least 14 days before the changes take effect and update the "Effective" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
